1 General
1.1 By participating in the Customer Survey Prize Draw (Promotion), each participant agrees to be bound by these terms and conditions.
1.2 The promoter is Netregistry Pty Ltd ABN 13 080 859 721 of Level 7, 505 Little Collins Street, Melbourne VIC 3000 (Promoter). The Promoter is a wholly owned subsidiary of Webcentral Limited ABN 21 073 716 793.
1.3 The Promotion commences at 12.01am (AEST) on Thursday, 2nd February 2023 and closes at 11.59pm (AEST) on Thursday 16th February 2023 (Promotion Period).
1.4 Entry is open to Australian residents only, aged eighteen (18) years or older at the time of entering, and not an employee or contractor, or immediate family member of an employee or contractor, of the Promoter, its related parties, or any third parties associated with this Promotion, and have a valid and active account on http://www.webcentral.com.au (Website) in good standing (for example, the account is not restricted or limited in any way, and does not have a negative balance).
1.5 The Promoter reserves the right to alter the terms of this Promotion at any time. The Promoter, in its discretion, and at any time, may terminate this Promotion.
1.6 These Terms and Conditions are governed by the laws of the State of Victoria.
2 How to Enter
2.1 To enter this Promotion, the participant must complete the customer survey about Webcentral Internet sent to the e-mail registered to the participant’s Webcentral profile on the Website. The participant must complete the Survey by including the participant’s first name, last name, nominated e-mail address, and phone number, before the expiry of the Promotion Period.
A Survey that does not include the participant’s first name, last name and phone number will not be considered as complete for the purposes of this Promotion.
2.2 Multiple entries are not permitted.
2.3 Participants can only enter in their own name. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render all entries submitted by that individual invalid.
2.4 All entries are deemed to be received at the time of receipt by the Promoter not time of transmission by the participant. The Promoter is not responsible for any entries not received by the Promoter or for any delays in the delivery of any entries.
2.5 The Promoter reserves the right, at any time, to verify the validity of entries and participants (including age, residence or identity) and to disqualify any person (including Page 2 of 3 any winner), in its sole discretion, who submits an entry that is not in accordance with these Terms and Conditions, from participating in this Promotion.
2.6 Entries not completed in accordance with these terms and conditions are void.
3 Draw and Prize
3.1 The prize draw will be conducted via random electronic selection at Level 7, 505 Little Collins Street, Melbourne VIC 3000 on Monday, 20th February 2023.
3.2 One (1) winner will receive a $100.00 gift card (Prize).
3.3 The winner of this Promotion will be notified via e-mail to their nominated address within fourteen (14) days of the close of the Promotion Period.
3.4 The winner of this Promotion must have a valid and active account on the Website.
3.5 The Promoter reserves the right to determine the kind of gift card the winner will receive.
3.6 The Promoter reserves the right to determine the manner in which the gift card will be sent to the winner.
3.7 If the winner cannot be contacted (for example, the Promoter receives an automated non-delivery report from the winner’s e-mail service provider), the Promoter has the right to select a new winner. Unforeseen or changed circumstances impacting the winner’s ability or availability to use the Prize will not entitle the winner to any compensation, alternatives, replacements or cash payments.
3.8 The total value of the prize pool is $100.00.
3.9 The Prize can only be used by the winner within the period of validity stipulated on the gift card (Period of Validity).
3.10 Any unused portion of the Prize will expire after the Period of Validity.
3.11 The Prize is non-transferable, non-refundable, cannot be sold, or exchanged for cash.
4 Liability
4.1 Except for any liability that cannot be excluded by law, the Promoter excludes all liability (including negligence) for any personal injury or death, or any loss (including loss of opportunity or any consequential loss), or damage (including damage to property) whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to:
(a) any variation or cancellation of the advertising and subsequent unavailability of the Prize;
(b) any technical difficulties, technical error or equipment malfunction (whether or not under the Promoter’s control);
(c) any error, omission, interruption, deletion, delay, defect, theft, unauthorized access or third party interference;
(d) any variation in prize value to that stated in these Terms and Conditions; Page 3 of 3
(e) any tax liability incurred by a winner or contestant. To avoid doubt, any tax payable in connection with the Prize is the sole responsibility of the winner;
(f) any failure for the Prize to be delivered by a certain time; or
(g) any use of, or inability to use or enjoy the Prize.
5 Privacy Policy
5.1 By entering this promotion, the Participant agrees to subscribe to the Webcentral newsletter and receive future Webcentral marketing material.
5.2 The Participant’s information is collected by the Promoter and will be used and held to administer this Promotion, in accordance with its Privacy Policy, available at http://www.webcentral.com.au/legals/privacy-policy/.
